Do you need to file a consumer complaint against an insurance company? The Division works closely with the Consumer Services Division in addressing consumer complaints involving coverage issues or rating questions. 

 

The Division, however, handles all complaints regarding insurance policies for workers' compensation and employers’ liability.  Click on the link to email us any complaints you might have about workers’ compensation and employer liability rates or policy form issues.

Arkansas Medical Malpractice Insurance Sources  - Here is a list of all insurance companies writing and agents marketing medical malpractice insurance.

Employee Leasing Firms Licensed in Arkansas and Professional Employer Organizations. By using our Company Search database you can find out if someone offering professional employer services holds a valid license to sell the services.  You can also get a complete listing of every licensed professional employer organization doing business in Arkansas.  On January 1, 2004, all employee leasing firm licenses expire.  To continue operating, the company must obtain a professional employer license.  Until January 1, 2004, you can also get a listing of employee leasing firms from the Company Search database.

Earthquake Authority Act- A Market Assistance Program (MAP) has been developed as a result of the Arkansas Earthquake Authority Act of 1999 The MAP is designed to assist consumers who are unable to find residential earthquake insurance through traditional sources. Additional information is available by calling 1-800-852-5494.

Flood Insurance. Flood insurance is provided by FEMA under the National Flood Insurance Plan. The FEMA website contains for consumers including assessing your flood risk and finding an insurance agent.

High-risk insurance pools - High risk pools are designed to provide coverage for consumers who are unable to secure insurance in the voluntary market. The Property and Casualty Division of the Arkansas Insurance Department manages the residual or assigned risk plans for workers' compensation and automobile insurance. Additionally, fire insurance is available through a Rural Risk Underwriting Association, which provides coverage for structures located in rural areas--where coverage is not available in the voluntary market.   Please email us for more information or contact your insurance agent.


Rates and Forms - The Property and Casualty Division reviews policies prior to distribution and use by consumers. These policies are reviewed to ensure compliance with Arkansas law.  Forms must be approved prior to use except for some exceptions. Proposed rate changes by insurers must be filed with the Arkansas Insurance Department at least twenty (20) days prior to the effective date. If the requested rate change is determined to be neither excessive, inadequate, or unfairly discriminatory, it is "filed" by the Insurance Department and the insurer may begin to use the new rate twenty (20) days after the "filed" date.

Consumer Brochure on use of credit in homeowners and personal automobile insurance is now available.  This brochure contains information about Act 1452 of 2003 and its affect on the use of credit information in homeowners and personal automobile insurance underwriting and rating.

Information on Surplus Lines - When licensed insurers are unwilling or unable to provide needed coverage, consumers can secure coverage with an approved surplus line insurer through a licensed surplus line broker. Individuals or corporations may secure insurance coverage directly from a non-admitted insurer. This coverage is considered "self-procured."
