Usually, an insurer’s agent for service of process is its registered agent. All foreign and alien insurers, all domestic reciprocal insurers, stipulated premium insurers, fraternal benefit societies, automobile clubs, mutual assessment life and disability insurers, life care providers, health maintenance organizations, and hospital and medical associations holding a subsisting certificate of authority are subject to Ark. Code Ann. §§23-63-301, et seq. These companies are required to continuously maintain a registered office, along with a registered agent at that office, in this state. If no registered agent has been appointed, service may be processed through the Commissioner, or by any other method of service provided under Arkansas law. To serve the Commissioner, be sure to include a $25 check made out to “Arkansas Insurance Department.” For detailed information regarding appointment and change of registered agent, please see Bulletin 3-2002.
The Commissioner is not authorized by law to accept service of process for any type of insurer other than those listed above. Other types of companies, such as domestic stock or mutual insurers, must be served in accordance with Ark. Code Ann. § 23-79-205.
The Arkansas Rules of Civil Procedure and the Federal Rules of Civil Procedure should always be followed when effectuating service of process.
