Under Ark. Code Ann. § 23‑67‑202(1)(A)(i), an “advisory organization” or “rate service organization” is defined as any entity that:
- has two or more member insurers, or
- is directly or indirectly controlled by two or more insurers licensed under Ark. Code Ann. § 23‑67‑214, and assists insurers with ratemaking‑related activities as outlined in Ark. Code Ann. § 23‑67‑216.
For purposes of this definition, two or more insurers operating under common ownership, management, or control are considered a single insurer.
The Arkansas Insurance Department does not require a formal application form for advisory organizations.
